Injured Spouse (Form 8379) vs. Innocent Spouse (Form 8857)

Taxpayers frequently confuse Form 8379 (Injured Spouse) with Form 8857 (Innocent Spouse). You file Form 8379 when you are owed a joint refund, and your share of the overpayment is seized by the Bureau of the Fiscal Service's Treasury Offset Program (TOP) for a debt that is legally your spouse's sole responsibility (such as pre-marital student loans, past-due child support, or state unemployment overpayments). You do not enter dollar calculations in Part IV—the IRS computes the final allocation from your Part III entries.

IRS Form 8379 Worked Example: Protecting Your Share of a Joint Tax Refund

In a separate-property state, the injured spouse earned $60,000 (60% of the $100,000 joint income) and had $6,500 withheld; the debtor spouse earned $40,000 (40%), had $3,500 withheld, and owes $5,000 in past-due child support. With $7,200 of joint tax and $2,000 of refundable credits, the total joint refund is $4,800. Allocating 60% of the net tax ($4,320) and 60% of the credits ($1,200) to the injured spouse leaves them with $6,500 + $1,200 − $4,320 = $3,380 protected refund, while only the debtor spouse's $1,420 share is seized toward the $5,000 debt.

Common questions

How long does IRS Form 8379 take to process?

According to the IRS Instructions for Form 8379, allow 11 weeks if you file Form 8379 electronically with your joint Form 1040, 14 weeks if you mail a paper joint return with Form 8379 attached, or 8 weeks if you file Form 8379 by itself after receiving a Treasury Offset notice.

How does Form 8379 work in community property states like Texas or California?

In the 9 community property states (AZ, CA, ID, LA, NV, NM, TX, WA, WI), community income and withholding are generally split 50/50, though overpayments protection varies depending on whether state law permits a pre-marital or child-support creditor to reach community assets.

Can I file Form 8379 after the IRS already took our tax refund?

Yes. If your joint refund was already offset, file Form 8379 by itself (check Box 2d if you are no longer at the same address or want a separate check) within 3 years from the due date of the original return or 2 years from the date the tax was paid.
