What Form 2441 claims
Form 2441 claims the child and dependent care credit for care that lets you (and your spouse) work or look for work: daycare, preschool, before- and after-school care, day camp and care for a disabled spouse or dependent. Children must be under 13. Overnight camp and school tuition from kindergarten up don't count.
2026 rules after the 2025 tax law
- Expense limit: $3,000 for one qualifying person, $6,000 for two or more, and no more than the lower-earning spouse's earned income.
- Credit rate: 50% at AGI of $15,000 or less, falling 1 point per $2,000 to 35%; then above $75,000 ($150,000 joint) it falls 1 point per $2,000 ($4,000 joint) to 20%, reached above $103,000 ($206,000 joint).
- Dependent care FSA: the tax-free limit rises to $7,500 ($3,750 married filing separately) from 2026, and FSA money reduces the expenses you can claim.
- The credit is nonrefundable: it can cut your tax to zero but not below.
Worked example
A family with two children in daycare, $12,000 of costs and $60,000 of AGI counts $6,000 of expenses at a 35% rate: a $2,100 credit. At $100,000 of AGI a single parent's rate is 22% ($1,320), while a married couple at $100,000 keeps 35%. With a $7,500 FSA, the FSA already covers more than the $6,000 limit, so no credit is left, but the FSA saves tax at your marginal rate plus 7.65% FICA. Pair it with the Schedule 8812 child tax credit calculator.
