OT calculator for the 2025โ2028 overtime tax deduction
The "no tax on overtime" deduction lets you subtract the extra half of FLSA time-and-a-half pay (the premium above your regular rate) from taxable income, up to $12,500 ($25,000 married filing jointly). It reduces income tax only; Social Security and Medicare still apply.
How overtime is calculated
- Federal rule (FLSA): non-exempt employees get at least 1.5 times their regular rate for every hour over 40 in a workweek. At $22 an hour, overtime is $33 an hour, so 48 hours pays $880 + $264 = $1,144.
- Workweek, not pay period: each 7-day workweek is counted separately. 30 hours one week and 50 the next means 10 overtime hours, even though the two weeks average 40.
- Regular rate includes bonuses: non-discretionary bonuses (production, attendance or shift bonuses) are added to the regular rate, which raises the overtime rate.
- State rules: California also pays 1.5ร after 8 hours in a day and 2ร after 12. Alaska, Nevada and Colorado have daily overtime rules too. The time card calculator handles California daily overtime.
- Exempt staff: salaried employees paid at least $684 a week who meet the duties tests are exempt from federal overtime.
Common questions
How do I calculate time and a half?
Multiply your hourly rate by 1.5. $20 an hour becomes $30 an hour for overtime hours.
How much is 10 hours of overtime at $25 an hour?
$25 ร 1.5 ร 10 = $375, on top of your pay for the first 40 hours ($1,000).
Is overtime based on hours over 8 a day?
Not under federal law, which uses hours over 40 in a workweek. A few states, including California, also require daily overtime.
Is overtime pay tax-free now?
Not entirely. For 2025 through 2028 you can deduct the premium part of qualified overtime (up to $12,500, or $25,000 joint) from income tax, with a phase-out above $150,000 ($300,000 joint) of MAGI. Social Security and Medicare still apply.
Do bonuses change my overtime rate?
Non-discretionary bonuses do. They're added to your regular rate for the weeks they cover, so overtime for those weeks is paid at a higher rate.
