Illinois guideline maintenance (750 ILCS 5/504)
If the court decides maintenance is appropriate, Illinois uses a statutory formula when the couple's combined gross income is under $500,000 and the payer doesn't already owe support from a prior relationship:
- Amount: 33⅓% of the payer's net annual income minus 25% of the recipient's net annual income.
- Cap: the recipient's net income plus maintenance can't exceed 40% of the couple's combined net income.
- If maintenance plus child support would exceed 50% of the payer's net income, the court may set non-guideline amounts.
Duration multipliers
Length of the marriage (to the date the case was filed) times a factor: 0.20 under 5 years, rising by 0.04 for each year to 0.80 for 19 to 20 years. For 20 years or more, the court orders maintenance for a period equal to the marriage, or indefinitely.
Worked example
Net incomes of $120,000 and $30,000: the formula gives $40,000 − $7,500 = $32,500; the 40% cap allows $30,000 (40% of $150,000 = $60,000, minus the recipient's $30,000), so maintenance is $30,000 a year ($2,500 a month). After a 12-year marriage the factor is 0.52, about 6.24 years. Compare California and Florida; this is an estimate, not legal advice.
