California overtime rules
California's overtime law (Labor Code 510, Division of Labor Standards Enforcement) is stricter than the federal 40-hour rule. Non-exempt employees get:
- 1.5x for hours over 8 in a workday, over 40 in a workweek, and the first 8 hours on the seventh consecutive day worked in a workweek.
- 2x (double time) for hours over 12 in a workday and over 8 on the seventh consecutive day.
- Overtime is paid at the regular rate, which includes non-discretionary bonuses and shift differentials. Hours already paid as daily overtime aren't counted again toward the 40-hour weekly total.
Approved alternative workweek schedules (such as four 10-hour days) can change the daily threshold.
Worked example
Five 10-hour days at $25 an hour is 50 hours: 40 regular hours and 10 daily overtime hours (2 a day over 8). California pay is $1,375.00. Under federal rules alone it's the same here (10 hours over 40), but a week of four 12-hour days (48 hours) gets 16 California overtime hours versus 8 federally.
Taxes on California overtime
The federal no tax on overtime deduction (2025-2028) only covers the FLSA premium, the half-time on hours over 40 a week, not California-only daily overtime or double time. California taxes all overtime as wages. Run the whole week on the overtime calculator and your net with the bring home pay calculator.
